Welcome to EquityEd, operated by the Institute for Equity in International Education ("EquityEd", "we", "us" or "our").
These Terms and Conditions ("Terms") govern your use of the EquityEd website, online learning platforms, courses, educational programs, resources and related services (collectively, the "Services").
By accessing our website, registering for a course, submitting an application, enrolling in a program, attending a class, or otherwise using our Services, you agree to be bound by these Terms.
If you do not agree with these Terms, you should not use our Services.
1. About EquityEd
EquityEd is an Australian social enterprise focused on expanding access to practical, inclusive and internationally accessible education.
Our educational offerings may include higher education, vocational education, business and entrepreneurship programs, digital skills programs, secondary education initiatives, community education and other learning programs.
Our programs may be delivered online, through virtual classrooms, mobile-friendly platforms, asynchronous learning systems, or other digital and educational delivery methods.
2. Eligibility
You must provide accurate and complete information when registering, applying or enrolling with EquityEd.
Depending on the course or program, eligibility requirements may include:

Previous educational qualifications

Prerequisite courses or subjects

If you are under 18 years of age, you must obtain any consent required by law from a parent or legal guardian before enrolling or using relevant Services.
3. Course Information

4. Educational and Accreditation Status
Unless expressly stated otherwise, completion of an EquityEd course does not necessarily constitute a qualification, award, licence, registration or accreditation recognised by an Australian government authority, professional body, university, regulator or overseas institution.
Where a course or qualification is formally accredited, registered, recognised or delivered in partnership with another institution, the applicable accreditation or recognition will be identified in the relevant course information.
Participants should independently confirm whether a qualification or certificate meets the requirements of a particular employer, professional body, educational institution, government authority or regulator.
EquityEd does not guarantee that completion of a course will result in employment, promotion, admission to another institution, professional registration, business success or any particular financial outcome.
5. Enrolment and Acceptance
Enrolment may be subject to:
Submission of an application
Acceptance by EquityEd
Payment of applicable fees
Satisfaction of admission requirements
Availability of places
Acceptance of any course-specific terms
An application does not guarantee admission.
EquityEd may decline an application where reasonably permitted by law.
6. Fees and Payments
Where a course or service carries a fee, the applicable price will be communicated during the enrolment or purchasing process.
Unless otherwise stated:

Participants are responsible for providing accurate payment information
Applicable taxes or charges will be disclosed where required
Third-party payment processing may be used
Additional costs associated with a participant's internet connection, device, software or telecommunications services are the participant's responsibility
EquityEd does not control fees charged by banks, payment providers, telecommunications providers or other third parties.
7. Refunds and Cancellations
Refunds and cancellations will be handled according to the applicable course or enrolment terms and the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
If a participant wishes to cancel an enrolment or request a refund, they should contact EquityEd as soon as reasonably possible at:
Where a course-specific refund or cancellation policy applies, that policy will form part of the applicable agreement.
8. Australian Consumer Law
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
To cancel your service contract with us
To a refund for the unused portion, or compensation for its reduced value
To compensation for any other reasonably foreseeable loss or damage
Nothing in these Terms is intended to remove or limit any rights you have under applicable consumer protection legislation.
9. Online Learning and Technology
Many EquityEd programs are delivered using internet-connected technologies.
Participants are responsible for having reasonable access to:
A compatible device
An internet connection
Required software or applications
A functioning email address
Any other technology specified for the course
We aim to provide accessible and reliable online learning services, but we cannot guarantee uninterrupted availability of the internet, telecommunications networks, third-party platforms or other infrastructure outside our reasonable control.
10. Virtual Classes and Participation
Participants are expected to participate respectfully and appropriately in online classes and learning activities.
Participants must not:
Disrupt classes
Harass, threaten or intimidate another participant, educator or staff member
Engage in discriminatory or hateful conduct
Impersonate another person
Share another participant's personal information without permission
Record or distribute classes without appropriate permission
Submit fraudulent or misleading information
Use EquityEd systems for unlawful activities
Interfere with the operation or security of EquityEd's technology systems
11. Academic Integrity
Participants are expected to maintain appropriate standards of academic and intellectual integrity.
Unless expressly permitted by the relevant course:
Submitted work must be the participant's own
Plagiarism is prohibited
Cheating is prohibited
Falsification of information or assessment results is prohibited
Impersonation is prohibited
Unauthorised collaboration or assistance may be prohibited
Where academic misconduct is suspected, EquityEd may investigate the matter and take appropriate action consistent with applicable policies and law.
12. Use of Artificial Intelligence
Where a course permits the use of artificial intelligence tools, participants must use those tools responsibly and in accordance with the requirements of the relevant course.
Unless expressly permitted, participants must not submit AI-generated material as their own original work where doing so would constitute academic misconduct.
Participants remain responsible for the accuracy, originality and integrity of work they submit.
13. Intellectual Property
Unless otherwise stated, EquityEd or its licensors retain all rights, title and interest in materials provided through the Services, including:
Course materials
Videos
Presentations
Written materials
Graphics
Logos
Assessments
Software
Website content
Other educational resources
You may use course materials for your own personal educational purposes in accordance with the relevant course.
You must not, without prior written permission:
Reproduce substantial portions of course materials
Sell or commercially exploit course materials
Distribute course materials to third parties
Upload course materials to unauthorised platforms
Create unauthorised derivative materials
Represent EquityEd materials as your own
14. Participant Content
Where participants submit assignments, comments, questions, feedback or other content ("Participant Content"), the participant retains ownership of their intellectual property rights in that content, subject to any rights granted to EquityEd under the applicable course arrangements.
By submitting Participant Content, you grant EquityEd a non-exclusive, royalty-free licence to use, reproduce and process that content to the extent reasonably necessary to provide, administer, assess and improve the relevant educational service.
15. Recording of Classes
Some online classes, tutorials or educational activities may be recorded for educational, administrative, quality assurance or accessibility purposes.
Where recording is used, EquityEd will provide appropriate notice where required.
Participants must not independently record, reproduce, distribute or publish classes or other participants' contributions without appropriate permission.
16. Privacy and Personal Information
EquityEd may collect and use personal information necessary to:
Process applications and enrolments
Provide educational services
Communicate with participants
Administer assessments
Issue certificates or records
Maintain academic and administrative records
Provide student support
Improve our Services
Comply with legal obligations
Protect the security and integrity of our systems

20. Participant Responsibilities
Participants are responsible for:
Providing accurate information
Maintaining the security of their account credentials
Completing required learning activities

Complying with course requirements
Respecting educators, staff and other participants
Maintaining appropriate technology access
Complying with applicable laws
21. Suspension or Termination
EquityEd may suspend or terminate access to a Service where reasonably necessary because of:

Academic misconduct
Abusive, threatening or unlawful behaviour
Misuse of technology systems
Fraud
Non-payment of applicable fees
Legal or regulatory requirements

22. Accessibility and Inclusion
EquityEd is committed to providing inclusive and accessible educational opportunities.
We recognise that participants may have different technological, linguistic, cultural, educational and accessibility requirements.
Where reasonably practicable, we will consider reasonable requests for adjustments or accessibility support.
Participants should contact us as early as possible if they require assistance.
23. International Participants
EquityEd provides educational opportunities to participants in different countries and regions.
Participants are responsible for ensuring that their participation in a course or use of an online service is lawful in their country or location.
EquityEd does not guarantee that every course, qualification, certificate or educational program will be recognised by authorities, employers or educational institutions in every country.
24. No Guarantee of Outcomes
Education can provide knowledge, skills and opportunities, but EquityEd does not guarantee any particular outcome from participation in a course.
In particular, we do not guarantee:
Employment
Income
Business success
Promotion
University admission
Professional registration
Immigration outcomes
Funding
Scholarships
Any particular academic or commercial result
25. Limitation of Liability
To the maximum extent permitted by law, EquityEd will not be responsible for loss or damage arising from matters outside our reasonable control, including failures of third-party telecommunications, internet services, platforms, infrastructure or equipment.
Nothing in these Terms excludes, restricts or modifies liability or rights that cannot legally be excluded, restricted or modified.

29. Governing Law
These Terms are governed by the laws applicable in the State of Victoria, Australia, subject to any mandatory laws that apply to a participant in another jurisdiction.
Any dispute that cannot be resolved through reasonable discussion will be subject to the applicable courts and dispute-resolution mechanisms having jurisdiction.
30. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed to the extent necessary, and the remaining provisions will continue to operate to the extent permitted by law.
31. No Waiver
A failure or delay by EquityEd to exercise a right under these Terms does not constitute a waiver of that right.
32. Entire Agreement
These Terms, together with any applicable course-specific terms, enrolment agreements, policies and information provided during the enrolment process, form the agreement between you and EquityEd regarding the relevant Services.
If there is an inconsistency between these Terms and a specific course agreement, the specific course agreement will apply to the extent of the inconsistency.
